This is used in cases where the litigating party is trying to prevent serious harm or injustice that would occur should the application take place.

3. Process: A stay of execution litigation usually follows a process as follows:

  • Application: The party litigating applies to the relevant court and requests a stay of execution. In the application petition, the reasons for the damage and the necessity of postponement should be explained in detail.
  • Request for injunctive relief: The party litigating may request a temporary injunction to prevent the execution of the transaction or decision. The court considers this request.
  • Objection: The opposing party may object to the request for a stay of execution and present its own arguments.
  • Court order: The court may accept or reject the request for a stay of execution after hearing the arguments of the parties. It may also take an injunction order.

4. Effects: When a stay of execution decision is made, the relevant decision or process is suspended temporarily. This may continue until the original case is settled. However, an important point that should not be forgotten is that the decision to stay the execution is not a final result either. Depending on the outcome of the original case, the court may withdraw the stay of execution or decide to continue the practice.
